Terms of Service
These terms cover your use of the DriveScape website and the general terms of buying the app. DriveScape and this site are run by BrickLogic, a one-person sole proprietorship (individual entrepreneur) based in Ukraine. The app itself is licensed to you under a separate End-User License Agreement (EULA), and your payment is handled by Paddle as Merchant of Record. Because we keep no contact form, this page also serves as our operator disclosure - reach us by email at support@bricklogic.dev.
1. About these terms & who we are
These Terms of Service (the "Terms") govern your use of the DriveScape website at this domain (the "Site") and the general terms on which we sell the DriveScape app. By using the Site or buying DriveScape, you agree to these Terms.
DriveScape and this Site are operated by BrickLogic, a sole proprietorship (an individual entrepreneur) run by a single developer. BrickLogic is not a limited company. In these Terms, "we", "us" and "our" mean BrickLogic.
The app itself is licensed to you under a separate agreement - the End-User License Agreement (EULA). Where these Terms and the EULA overlap on the app, the EULA controls for the app licence. How we handle data is described in our Privacy Policy.
Because we do not run a contact form or a separate contact page, these Terms also serve as our operator disclosure. The only way to reach us is by email at support@bricklogic.dev.
2. Using the website
The Site is provided "as is" and "as available", mainly to tell you about DriveScape and to let you buy it. We may change, suspend or remove parts of the Site at any time.
You agree to use the Site lawfully and not to misuse it. In particular, you must not:
- scrape, crawl, harvest or bulk-download the Site except as a normal search engine would;
- attack, overload, probe or attempt to gain unauthorized access to the Site or its infrastructure;
- interfere with how the Site works for anyone else, or attempt to circumvent any security or rate-limiting;
- use the Site to break the law or to infringe anyone's rights.
3. Buying DriveScape
DriveScape is a one-time purchase of US$8. What you receive is a licence to use the app, governed by the EULA - including how many machines you can activate (up to 5 you own or control), what updates are covered, and the permitted uses. Please read the EULA before you buy; that is the contract for the app itself.
Checkout and payment are handled by Paddle as the Merchant of Record. This means Paddle - not BrickLogic - is the seller for the payment transaction: it processes your payment, charges any applicable VAT or sales tax, and issues your invoice. Your payment contract is with Paddle, and your billing details are collected and processed by them under their own terms. The app licence itself is granted to you by BrickLogic.
After a successful purchase, you receive an offline activation code by email. DriveScape needs no account and no login.
4. Refunds
DriveScape is delivered instantly as a digital download. At checkout you consent to immediate delivery and acknowledge that the statutory right of withdrawal (the "cooling-off" period) ends once your activation code has been sent.
If the app does not work and we cannot fix it, contact us by email and a refund may be issued. Refunds are processed by Paddle under its own refund policy. The full refund terms live in the EULA under "Purchases, payment, and refunds" - please refer to that section. Nothing here removes any refund or other right you may have under mandatory consumer-protection law.
5. Intellectual property of the site & brand
The Site and its content - text, layout, graphics, and the "DriveScape" name and sunburst mark - are owned by BrickLogic or its licensors and are protected by intellectual-property laws. The "DriveScape" name and the sunburst mark are trademarks of BrickLogic.
We grant you no rights in our trademarks or Site content except to view the Site for its intended purpose. You may not copy, reproduce, republish or reuse Site content or our branding without our written permission. Your rights in the app are limited to those in the EULA.
6. Third-party links & services
The Site links to and relies on third-party services - most notably Paddle for checkout and payment, and may link to other external sites. We do not control those services and are not responsible for their content, availability, terms or privacy practices. When you use a third-party service, that service's own terms and policies apply.
7. Disclaimers & limitation of liability
The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free or secure.
To the maximum extent permitted by law, BrickLogic will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the Site or your purchase. Our total liability to you for any claim relating to the Site or a purchase is limited to the amount you actually paid for DriveScape (US$8). This mirrors the liability cap in the EULA.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or your statutory consumer rights.
8. Changes to the service or these terms
We may update these Terms from time to time - for example, to reflect changes to the Site, our pricing, or the law. When we do, we will update the "Last updated" date below. Changes take effect when posted, and your continued use of the Site after that means you accept the updated Terms. The version in force for a purchase is the one shown at the time you bought.
9. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. If you are a consumer, you may also benefit from the mandatory protections of the law of your country of residence - nothing here removes those rights.
